These are the Terms and Conditions of Energy Logistix (Aust) Pty Ltd (ABN 21 141 851 925) (“Energy Logistix”, “ELX”, “we”, “us”) on our website located at energylogistix.com.au, which is owned and operated by us (Website). These Terms and Conditions also incorporate our Terms of Use, Disclaimer and Privacy Policy, all of which can be found on our Website.
Please read these conditions carefully, as they apply to all transactions between us and can only be waived or varied in writing signed by us. By proceeding with a purchase on our Website, you indicate that you have read, understood and agreed to these conditions. If you have any questions or concerns about our conditions or Website, or any purchase you make through the Website, please contact us.
1. ECommerce
While we take every care to ensure our online store is accurate and up to date, mistakes may occur from time to time (for example, pricing errors or stock availability issues).
When you submit an order through the Website, no agreement is formed until we process and accept your order and send you a confirmation. If there has been an error relating to your order (such as a pricing or stock error), we may choose not to fulfil the order. We will contact you to discuss your options (for example, placing an order at the correct price, delaying your order, or exchanging your item for another). If we cannot or will not fulfil your order, we will process a full refund as soon as practicable.
2. Payment
You agree to pay the purchase price listed on the Website (subject to the proviso above regarding accidental errors and omissions). We may vary our prices from time to time. You acknowledge that we may do so at any time on notice, which is given by posting the updated price on our Website.
Payment in full in cleared funds (including any applicable postage fees) is a condition of this agreement. Any breach entitles us to terminate the agreement immediately. If a payment request is returned or denied by your financial institution, or remains unpaid for any reason, you are liable for any associated costs incurred by us, including banking fees and charges. We may immediately stop delivery of any unpaid goods unless and until payment is received in full.
If you fail to pay for an order, or if an insolvency event occurs in relation to you (for example, committing an act of bankruptcy or becoming insolvent), we may suspend delivery, require payment in a particular form, or terminate this agreement.
We currently accept payments via PayPal or Stripe.
By making a payment, you warrant that you have read and agreed to the terms of any third-party payment gateway, processor, or credit provider (such as PayPal, AfterPay, or ZipPay). These services are provided by third parties and made available on our Website for convenience only. We are not responsible for any issues, loss, or damage arising from those facilities. If you experience an issue with a third-party provider, please contact them directly.
3. Discounts and Coupon Codes
We may offer discounts or coupon codes from time to time.
Discounts and coupon codes cannot be used in conjunction with any other offer. If multiple promotions are available at the same time, only one discount or coupon code may be applied per purchase.
Unless otherwise stated, discounts and coupon codes are valid for the stated period, or for seven (7) days from the date first offered, or until stocks last (whichever occurs first).
Unless specified otherwise, discounts and coupon codes apply to full-priced goods only.
Coupon codes are non-transferable and not redeemable for cash.
We reserve the right to revoke any discount or coupon code at any time without notice.
4. Postage and Delivery
We ship products within Australia and internationally. We use third-party delivery service providers to deliver our products.
(a) Rates
You agree to pay postage fees as outlined in our Shipping Policy.
If there is an error in calculating postage costs, we will contact you before processing your order to discuss available options (such as paying additional costs or modifying your order).
Delivery service providers may change their fees from time to time. We may vary applicable postage fees at any time by posting updated fees on the Website.
(b) Dispatch Timeframes
Orders are processed within 48 hours of receipt of payment. Once processed, we aim to dispatch orders on the same or next business day.
Dispatch timeframes may vary during periods of high order volume. We are not liable for any delay in dispatch.
(c) Delivery Timeframes
Delivery times vary depending on the delivery service provider. As a general guide, orders should arrive within seven (7) days unless advised otherwise.
(d) Delivery Address
You are responsible for ensuring your postal address details are accurate and current. We are not responsible for incorrect or failed delivery due to inaccurate address details.
If an order is returned to us due to your error, we may require you to pay additional postage fees or terminate this agreement and issue a refund in accordance with these terms.
(e) Orders Lost in Transit
If you believe your order has been lost or misdelivered, please contact us as soon as possible so we can investigate.
While we will investigate missing orders, we make no representations regarding responsibility or liability for lost or misdelivered items. Our liability for items lost or damaged in transit is limited to any compensation recovered from the delivery service provider, less reasonable investigation costs, unless otherwise required by law.
(f) Risk
Risk in each order passes to you upon delivery to your nominated address.
You must sign for delivery unless you have authorised unattended delivery. If unattended delivery is authorised, the order is deemed delivered when left at the address. If another person at the address signs for the parcel, delivery is deemed complete at that time.
If we accept returned goods, risk reverts to us upon our confirmation of receipt. We recommend insuring returned goods against loss or damage in transit.
5. Events Beyond Control
We are not liable for delays or failures caused by circumstances beyond our control (including strikes, floods, fires, extreme weather events, computer malfunctions, service provider failures, or illness of key personnel).
During such events, you release us from any obligation to dispatch your order. We may cancel your order or complete it once circumstances return to normal. If a major delay is expected, we will contact you to discuss a suitable solution.
6. Advice and Information
Any advice, recommendations, information, or assistance provided in relation to products on our Website is given in good faith and believed to be accurate at the time. However, we do not warrant its accuracy, appropriateness, or reliability.
Information provided is general in nature and does not constitute professional or medical advice. You should seek appropriate professional advice where necessary.
We are not liable (including for negligence) for any loss arising from reliance on information provided on our Website, unless required by law.
7. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), being Schedule 2 of the Competition and Consumer Act 2010 (Cth).
If you are an Australian consumer under the ACL, you are entitled to:
A replacement or refund for a major failure; and
Compensation for any other reasonably foreseeable loss or damage; and
Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes rights you are entitled to by law. However, to the maximum extent permitted by law, we exclude all other guarantees, conditions, and warranties, including liability for negligence.
Where permitted, our liability is limited to:
Replacement of the product;
Repair of the product;
Payment of the cost of repair; or
Any other fair and reasonable remedy we choose to provide.
We are not liable for consequential or indirect loss except where such limitation is not permitted under the ACL.
If the ACL does not apply (for example, where goods are purchased for resale or outside Australia), we exclude all liability and will only refund orders where we cannot fulfil them or otherwise agree in writing. We do not provide refunds for change of mind.

8. Refund Procedure
If goods are damaged or defective upon delivery, contact shop@energylogistix.com.au as soon as possible to arrange a return, exchange, or refund.
You must notify us of faults within the period in which the fault would reasonably be expected to appear. Based on the nature of our products, this is estimated to be approximately fourteen (14) days.
Refunds are not provided for change of mind.
You are entitled to a refund or exchange for a major problem. A major problem exists where the item:
Would not have been purchased had the issue been known;
Is unsafe;
Is significantly different from the sample or description; or
Does not perform as described and cannot be easily fixed.
If the problem is not major, we will repair the item within a reasonable time. If not repaired within a reasonable time, you may choose a refund or replacement.
Please retain proof of purchase (e.g., your receipt).
9. Intellectual Property
All intellectual property rights owned by or licensed to us remain our sole property. Nothing in this agreement transfers ownership of any intellectual property rights to you.
10. Dispute Resolution
If a dispute arises, please contact us first so we can attempt to resolve the issue promptly and efficiently.
If unresolved within thirty (30) days, the dispute will proceed to mediation in South Australia (unless otherwise agreed in writing), with costs shared equally.
If mediation does not resolve the dispute within thirty (30) days, either party may request termination of mediation.
Neither party may commence court or tribunal proceedings until this clause has been complied with, except for interlocutory relief.
11. Variation
We may amend these conditions at any time by updating this document and posting it on the Website. Changes take effect immediately upon posting.
12. Severance
If any provision is found to be void or unenforceable, it will be severed and the remainder of the agreement will continue in force.
13. Termination
We may terminate this agreement at any time on notice. Disclaimers and limitations of liability survive termination. Upon termination, we will refund any amounts paid for undelivered goods.
14. Jurisdiction
These terms are governed by the laws of South Australia.
In the event of a dispute, you agree that the exclusive venue for proceedings will be the courts of South Australia and any courts of appeal from them.
